Defendant shall be punished by imprisonment for a term of one year and two months.
Reasons
Punishment of the crime
1. On April 17, 2010, at around 08:00 on April 17, 2010, the Defendant made a false statement to the victim J that “The Defendant would request the victim to supply credit the materials to reduce the price after completing the construction work and supply the materials to the victim on credit.”
However, the defendant did not have an intention or ability to pay the cost even if he was supplied with materials from the victim because he was unable to return the construction cost in excess of KRW 100 million at the time.
Nevertheless, the Defendant was supplied with construction materials equivalent to KRW 119,602,80 in total over 499 times, as shown in the attached list of crimes, including that he/she received a self-defluence of an amount equivalent to KRW 16,000 on the same day from the victim, from October 7, 2011.
Accordingly, the defendant was given property by deceiving the victim.
2. Around May 14, 2011, the defrauded of the Victim L said that, at a restaurant for the operation of the Victim L (M) located in Ansan-si, the Defendant provided the victim with meals “to pay food in cash on the end of each month on the face of the week by providing meals to the construction site employees.”
However, the defendant had no intention or ability to pay the cost, even if he received meals from the victim, because he had been unable to return the construction cost in excess of KRW 100 million at the time.
Nevertheless, the Defendant received meals equivalent to KRW 6.5 million from May 14, 201 to October 7, 201 of the same year, and did not pay the amount.
In this respect, the Defendant acquired pecuniary benefits by deceiving the victim.
3. On July 2, 201, around 08:00 on July 2, 201, the Defendant: (a) calculated the victim N, who is an indoor interior interior interior interior interior interior interior decoration at the construction site of a new construction site in Ansan-si; and (b) calculated 150,000 won per day at intervals of 10 days.
