The defendant company, a summary of the 300N/h level D development project, is a corporation established for the purpose of technical consultation, etc. on heating lines and ancillary matters required in the process from oil refineries factories, oil chemical factories, textile factories, etc., and of conducting research and development projects therefor. The defendant research institute is a corporation established for the purpose of researching and developing creative source technology leading national science and technology and distributing the outcomes thereof.

The plaintiff is a person who is engaged in the development and production of hydrogen generating devices in the trade name of "I".

In the first half of 2013, the Ministry of Trade, Industry and Energy publicly announced the task of “300NN/h grade D development (hereinafter “instant project”) as part of a new and renewable energy convergence source technology development project in order to build infrastructure for manufacturing hydrogen from natural gas through the Korea Institute of Energy Technology Evaluation and Planning to supply fuel cell vehicles which are future eco-friendly vehicles.

On June 21, 2013, Defendant Company is the major institution in charge of the instant project for industrial technology innovation (hereinafter referred to as “instant project plan”).
