피고인은 2013. 6. 22. 03:00경 서울 송파구 C에 있는 피해자 D(여, 28세)의 집 앞을 지나가다가 피해자를 강간하기로 마음먹고 잠기지 않은 현관문을 열고 집 안으로 들어가 피해자의 주거에 침입한 후, 방에서 항거불능의 상태로 자고 있는 피해자를 발견하고 피해자의 가슴과 음부 등을 입으로 핥고 손가락을 피해자의 성기에 집어넣어 애무하다가 피고인의 성기를 피해자의 성기에 삽입하여 피해자를 1회 간음하였다.
