Reasons
Punishment of the crime
On September 11, 2012, the Defendant drafted a loan document stating that “The monthly payment of KRW 2,218,358 is to be made for 48 months,” as the purchase price for D 14 tons of truck in the name of C, which is a shape of D 14 tons from the Korean Capital Capital Capital Capital Co., Ltd., Ltd., and that “The Defendant will pay KRW 2,218,358 of the monthly payment”.
However, from September 2001, the defendant had no intention or ability to repay the loan even if he/she received the loan from the victim due to the lack of specific property and certain income in the name of the defendant in a bad credit condition.
As above, the Defendant, by deceiving the victim, received 79,965,00 won from the victim, namely, the money from the victim and acquired it by deception.
around November 27, 2012, the Defendant drafted a loan application stating that “The Defendant will pay KRW 65,00,000 for monthly payment 1,868,858,858 for 48 months” in the name of H, the wife of G, i.e., the 14 tons from the Korean Capital Capital of the Victim Co., Ltd., through sharing the office of “Frenkk” in the Bupyeong-gu Incheon Bupyeong-gu, Incheon E, 102.
However, from September 2001, even if the Defendant did not have any property or income under the Defendant’s name and received a loan from the victim due to no certain income, the Defendant did not have the intent or ability to repay the loan, and even if having received the loan, there was no thought to use it for the purchase of the above vehicle.
Accordingly, the Defendant, by deceiving the victim as above, received 65,00,000 won from the victim to the account under the name of the Defendant B.
The defendant of "2014 Highest 581" has obtained a secondhand loan in the name of another person and purchased a secondhand freight vehicle and enter the transportation company, and made the vehicle into the transportation company by being granted a business number plate, and resells it to other persons and profits with the difference.
