A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. A thief: (a) around 04:00 on March 5, 2016, the Defendant: (b) stolen a galle-flue car owned by the victim E while under the influence of alcohol, by using a galle-glue-gamt2 in the market price, which was set on the table, when the victim refused it; and (c) galle-flue car, which was set off on the table.
2. The defendant is a person who is engaged in driving service of Faburged vehicle by violating the Act on Special Cases concerning the Settlement of Traffic Accidents, the Road Traffic Act, and the Road Traffic Act.
At around 04:07 on March 5, 2016, the Defendant, while under the influence of alcohol content of 0.109%, proceeded with the intersection in front of the entrance of the Jinsung elementary school located in the Jinsung-dong, Ansan-si, Ansan-si at an unfried speed at the chill of the winter-gu.
Since there is a place where the center line of yellow solid lines is installed, there was a duty of care to prevent accidents by thoroughly operating all-round and safely operating his own car lines.
