1. The defendant

(a) 92.4 square meters of a 1st floor store among the buildings listed in the attached list;

(b) from May 21, 2019.

Reasons

Comprehensively taking account of the overall purport of the statements and arguments as stated in Gap evidence Nos. 1 through 4, the plaintiff leased real estate listed in the attached list to the defendant in the amount of KRW 20 million, monthly rent of KRW 650,000,000 on May 17, 2018. The fact that the defendant did not pay KRW 8 million out of the lease deposit, and the plaintiff terminated the above lease contract on the ground of the defendant's default, and on May 20, 2019, deducted both the lease deposit from overdue rent.

Therefore, the defendant is obligated to order the plaintiff to use the above real estate and pay the amount of unjust enrichment equivalent to the rent of KRW 650,000 per month from May 21, 2019 to the completion date of the surrender of the above real estate.

The plaintiff's claim shall be accepted on the grounds of its reasoning.
