1. Defendant among the distribution schedule prepared on April 21, 2015 by the said court with respect to F real estate auction cases in the Chuncheon District Court.
Reasons
1. Facts of recognition;
A. On August 3, 2011, G completed the registration of the establishment of a mortgage of KRW 1.7 billion in total of KRW 73 billion from the Dongcheon Agricultural Cooperative (Seoul Agricultural Cooperative (hereinafter “Seoul Agricultural Cooperative”) and KRW 2.43 billion in total from KRW 7,400,000,000 from Chuncheon Agricultural Cooperative (hereinafter “Seoul Agricultural Cooperative”) as a security and completed the registration of the establishment of a mortgage of the Chuncheon Agricultural Cooperative (hereinafter “Seoul Agricultural Cooperative”) with the joint order of KRW 949,000,000 in total as shown in the attached list of the same day (hereinafter “instant real estate”).
B. After the completion of the registration of creation of the instant real estate on August 3, 2011, the said registration was completed: ① the debtor G, the maximum debt amount of KRW 45,00,000, the mortgagee C, and D; ② the debtor G, the maximum debt amount of KRW 169,00,000,000, and the mortgagee B; ③ the debtor G, the maximum debt amount of KRW 130,000,000, and the secured debt amount of KRW 33861 as of July 13, 201, were registered as the mortgagee, and ④ the debtor G, the maximum debt amount of KRW 20,000,000, and the secured debt amount of KRW 42168 as of September 4, 2012; ② the secured debt amount of KRW 160,000,000, the secured debt amount of KRW 300,000,000, the secured debt amount of KRW 18,20138,2008.
C. Meanwhile, from May 2012 to August 5, 2013, the Plaintiff, as indicated in the attached Table of Payment by Subrogation, transferred the remainder remaining after deducting the principal and interest from the Chuncheon Agricultural Cooperatives from its principal and interest, to the payment of the principal and interest of the Pacific Agricultural Cooperative, or paid in directly to the Seoul Agricultural Cooperative, thereby making a joint loan interest amounting to KRW 62,025,425 in subrogation.
In addition, with respect to the right to collateral security of the agricultural cooperative of East Chuncheon, it becomes the plaintiff of the right to collateral security on April 9, 2014, No. 16813, which was received on March 18, 2014.
