1. The Defendants: (a) each of the Plaintiff KRW 101,070,939 and KRW 42,118,261 among the Plaintiff, respectively, shall be the Defendants from June 7, 2013 to October 29, 2014.
Reasons
1. Facts of recognition;
A. 1) On April 18, 201, the Plaintiff is a part of 132 square meters among the buildings located in Seocheon-si B (hereinafter “instant building”).
B) As to the instant building (insurance value of KRW 167,579,788, insurance amount of KRW 110,00,000,00) and facilities inside the building (insurance value of KRW 23,68,768, insurance amount of KRW 10,000,00), movable property (insurance value of KRW 100,000,000, KRW 100,000, and KRW 100,000,00,000) between E and E occupying and using “D” in the course of operating “D,” the insurance period for the instant fire insurance contract (hereinafter “instant fire insurance contract”) from April 18, 201 to April 18, 2021.
(2) Defendant A is the insurer that entered into the instant building. (2) Defendant A is the owner of a Class II neighborhood living facility (private teaching institutes) of the light-stoke structure board, 360 square meters in size (hereinafter “Defendant building”); and Defendant A owns three factories on the G ground adjacent to the Defendant building (hereinafter “Defendant factory”) and runs a general gambling manufacturing business, etc. with the trade name “H”.
3) Defendant A leased approximately 280 square meters of the part among the Defendant’s building to “I” and used the remainder as a dormitory for employees working in the Defendant factory (hereinafter “instant dormitory”).
(4) On August 8, 2012, Defendant Hyundai Marine Fire Insurance Co., Ltd. (hereinafter “Defendant Hyundai Marine”) concluded a fire insurance contract with Defendant A as to the Defendant’s building, etc. including the instant dormitory, between August 8, 2012 and August 8, 2022, with Defendant A and the insurance period from August 8, 2012. The insurance amount of the fire liability security under the said fire insurance contract is KRW 300,000,000.
B. On March 24, 2013, the occurrence of fire and payment of insurance proceeds (on Sundays 21:15, following the occurrence of fire in the dormitory of this case, were spread to the building of this case.
