1. The Defendants jointly share KRW 37,127,041 with respect to the Plaintiff and 5% per annum from January 21, 2020 to July 9, 2020.
Reasons
1. Basic facts
A. The Plaintiff is a clan consisting of descendants of FC 5 years of age G, and the Defendants, as of January 27, 2010, were the Plaintiff’s members of the Plaintiff’s clan, Defendant B was the president (Resignation around December 2010), the standing vice president (the standing vice president around June 2012; the resignation of Defendant C was around November 201); Defendant D was the general secretary (Resignation around July 2012); and Defendant E was the financial director (Resignation around August 2013).
Plaintiff
According to the articles of incorporation, the chairperson shall act as the chairperson of the various levels of meetings on behalf of the chairperson, the vice-chairperson shall assist the chairperson, the vice-chairperson shall assist the chairperson, the vice-chairperson shall act on behalf of the chairperson, the general director shall take charge of general affairs and general affairs incidental to the operation of the council, and the financial director shall take charge of the management of the property and
B. On December 17, 1994, H filed a lawsuit against I for a loan claim and was sentenced to May 15, 1996, “I shall pay H 30,000,000 won with the interest of 5% per annum from October 16, 1993 to December 29, 1994, and 25% per annum from the next day to the date of full payment.”
(C) On December 5, 1996, the above judgment became final and conclusive on December 5, 1996.
C. On June 26, 2008, the Plaintiff entered into a lease agreement with I and Suwon-gu J 1st floor K on a deposit of KRW 10,000,000, monthly rent of KRW 880,000, and the lease period of KRW 1 year.
H On November 6, 2008, with the debtor and the plaintiff as the third debtor, the debtor and the plaintiff were ordered to attach and attach the claim(s) No. 2008 Other 19406 of Suwon District Court to KRW 40,00,000 to the plaintiff(s).
The above assignment order was confirmed on May 2, 2009.
E. H filed a lawsuit against the Plaintiff on October 1, 2009, and on January 11, 2010, the Plaintiff shall pay H KRW 40,000,000 to H until February 26, 2010. If the Plaintiff fails to pay the said amount by the payment date, the rate of 20% per annum from the date following the date of payment to the date of full payment.
