1. The Defendant’s KRW 98,127,346 among the Plaintiff and KRW 30,568,370 among the Plaintiff, shall be KRW 35,713,670 from February 6, 2016.
Reasons
1. Facts of recognition;
A. 1) The Defendant’s “B Corporation” (hereinafter “instant Corporation”)
(2) On June 15, 2015, the Defendant entered into a contract for construction with the Plaintiff for a total construction period of 3,58,711,00 won, the total construction period of 300 days from June 16, 2015 to April 10, 2016, the total construction period of 2,04,800 won, and the number of primary construction periods of 120 days from June 16, 2015 to October 13, 2015. The Defendant entered into a contract for construction with the Plaintiff for a total construction period of 3,579,746,000 won, and the total construction period of 3,579,746,000 won, from June 16, 2015 to April 10, 2016; and the construction period of 3,579,000 won to 3,576,000 won, 130,184.21.
(2) The term “instant construction contract” refers to “the instant construction contract”; however, the term “the instant construction contract” is divided into a general contract and a multiple-level contract, and each of the instant construction contract is indicated as a “general contract”, “the instant multiple-use contract”, “the general contract and the instant multiple-use contract”, and “the instant multiple-use modified contract”.
The Plaintiff and the Defendant modified the instant construction contract on several occasions and finally set the total contract amount of KRW 3,762,820,000 and the total construction period of the instant construction project on June 30, 2016. The details of and reasons for the change are as follows.
The total contract amount has increased or decreased by the same amount as the total contract amount(the original contract amount) in the event of an increase or decrease in the amount of each of the following changes in the contract amount(the original contract amount) for each of the changes in the completion date(the original contract) on the ground of the notification of the change in the terms of construction contract as the general contract date as the total completion date.
Extended 1: (a) 3,58,711,00 April 10, 2016 - 2,04,000 on June 15, 2015; (b) - October 13, 2015; (c) 3,58,711,000 on September 25, 2015; and (d) 10 April 10, 2016, reflecting the construction volume of the first installment, 2,047.
