Reasons
Punishment of the crime
[2017 High 225] The Defendant is the representative of Busan Shipping Daegu CD located in Busan Metropolitan City, who is an employer who conducts a parking lot service business using one full-time worker.
1. An employer who has clearly violated working conditions shall clearly state the working conditions, such as wages, by delivering a document in which the constituent elements, method of payment, etc. of wages are specified, to the workers when concluding a labor
Nevertheless, the Defendant concluded a labor contract with workers E on March 11, 2015, and did not specify in writing the working conditions such as wages.
2. An employer who fails to pay wages shall pay a retirement allowance within 14 days, if a worker retires.
From March 11, 2015 to April 13, 2015, the Defendant did not pay KRW 1,653,577, in total, the wage of KRW 1,653,575 on March 1, 2015 and KRW 1,50,325 on April 15, 2015, to the parking management personnel, within 14 days from the date of retirement without agreement on extension of payment period.
[2017 High 298] The Defendant is an employer who runs a parking lot service business using one full-time worker in the name of G from the Busan Young-gu F. G from the Busan Young-gu.
1. An employer who violates the minimum wage law shall pay workers a minimum amount of wages, and 5,580 won at a time from January 1, 2015 to December 31, 2015, and 6,030 won at a time from January 1, 2016 to December 31, 2016, respectively, were the minimum wage.
From July 26, 2010 to January 17, 2016, the Defendant paid the hourly wage of H from October 18, 2015 to January 17, 2016, and paid KRW 2,508 to KRW 3,618 below the minimum wage.
2. The Defendant in violation of the Labor Standards Act and the Labor Standards Act and the Act on Guarantee of Retirement Benefits for Workers from July 26, 2010 to January 17, 2016, paid his/her retirement allowance of H 9,764,072, and the wage of October 2015 below the minimum wage, thereby making the difference below the minimum wage.
