A defendant shall be punished by imprisonment for one year.

Punishment of the crime

[Criminal Modern] The Defendant was aware of working as a broker in the used cars trading company around C, D, E and 2004.

At around 22:00 on November 3, 2012, the Defendant: (a) used that, at the time of the purchase of used cars, there was a practice in which the installment financing company would receive a direct transfer of the above loan and pay the said loan; (b) used that C would be a disguised employment for a used car sales company; (c) applied for the above loan in the name of a person with good credit rating in the company for installment financing; (d) applied for a loan in the name of a person with good credit rating in the process; (e) the loan applicant was exempted from the obligation to repay the loan; (c) C would be exempted from the obligation to pay the loan; (d) Defendant D, E, and distributed the loan directly transferred from the company for installment financing; and (d) Defendant D, E, and E would be subject to prosecution by concluding an agreement with the company for installment financing or loan brokerage and thereby, under the restraint of a person under detention by a court.

Accordingly, around November 20, 2012, C was employed in disguisedly on the "J", a used motor vehicle trading company of the victim I operated by the victim H building 214 in Bupyeong-gu, Seocheon-gu, Seocheon-gu.

Afterwards, Defendant C, D, and E are suitable for credit rating of KR, which is referred to as D, at a non-severed place on November 2012, 201, with the view to obtaining a loan from KR and obtaining a license to purchase used cars in a normal way, and obtaining a license from KR to purchase used cars. In order to obtain a license to purchase used cars through C and apply for installment financing loans, the KR’s certificate of seal impression is affixed, but the KR’s certificate of seal impression is affixed to the installment financing company or its intermediary company without holding a seal imprint.
