Reasons
Punishment of the crime
On November 3, 2015, around 10:30, the Defendant inflicted injury on the victim D (55 years, n) who has a mental retardation in his dry field located in Spocheon-si, Spocheon-si, on the ground that the harvest of the victim D(55 years, n) voluntarily brings about the remaining straw of the victim, and her face is about three times at hand, and her face was about four times, and the victim suffered injury, such as the impairment of the shot part of the face that requires approximately two weeks of treatment.
Summary of Evidence
1. Partial statement of the defendant;
1. Witnesses D and E respective legal statements: Provided, That the witness E's legal statements are excluded from D's legal statements;
1. Each injury diagnosis certificate and a copy of medical record [the defendant and his defense counsel reported the victim to the police that he did not assault the victim at the time, while the victim was spawned from the Defendant's dry field, and the defendant added the victim to F along with his wife F. However, the victim was spawned and reported the victim to the police as larceny.
In light of the following circumstances, the evidence duly adopted and examined by this Court can be comprehensively adopted and examined by this Court, namely, ① it is evident that E, a female student of the victim, was suffering from an injury to the victim on November 3, 2015 when the victim discovered on November 3, 2015 (the victim was issued the first diagnosis letter stating the diagnosis, such as impairment of the face part, strawing, etc., at around 20:52 on November 3, 2015). ② The victim’s statement concerning the circumstance in which the victim was suffering and the victim’s statement were written. However, the Defendant also recognized that the victim was suffering from approximately 50 through 100 meters away from his own house and was assaulted or abused by the victim on November 3, 2015 (the victim stated that the victim was suffering from an injury).
