Reasons
Punishment of the crime
In fact, the Defendant, even if he received the advance payment from the victims, did not intend to board the fishing vessel operated by the victims for the agreed period, and acquired it by deceiving the victims more than 27 million won on five occasions as follows:
1. On October 24, 2017, the Defendant received a remittance of KRW 10 million to the F account in the name of the Defendant on the same day by falsely concluding that “the Defendant will work as a seafarer by boarding the victim at the victim’s residence located in Seopo-si B Stud C, Seopo-si, for a period of one year on the face of Jeju, for a period of ten million won.”
2. 3. 4. On March 23, 2018, the Defendant received KRW 3 million from the Defendant’s account in the name of the Defendant to the F account on the same day by falsely concluding that “the Defendant will work as a seafarer by boarding a vessel of KRW 3 million on the face of the week” to the victim M in the vicinity of the Sungsan Port located in Seopo-si, Seopo-si, Seopo-si.
5. On May 4, 2018, the Defendant was transferred KRW 4.5 million, including KRW 4 million on May 4, 2018, and KRW 5 million on May 10, 2018, to the Defendant’s account in the name of QF in the name of the Defendant, by falsely concluding that “the Defendant would have on board the ship to work as a seafarer on the Jeju-si P, Jeju-do.”
