1. The defendant shall be punished by imprisonment for one year;
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Even if the Defendant is not a narcotics handler, he dealt with the Metepha (one philopon, hereinafter “philopon,”) which is a local mental medicine as follows.
1. On February 8, 2016, the Defendant administered philophones by injecting approximately 0.05g of philophones into arms within E-car parked in a factory factory hole near the D elementary school located in Gwangju City, and by using a disposable injection device.
2. Around February 8, 2016, the Defendant conspiredd to purchase a penphone with E in a factory hole near the above D elementary school; E in a case of E, KRW 1.3 million; and the Defendant wired KRW 2.2 million in total to a person who is in the name of his/her mother, respectively, within KRW 9 million; on February 9, 2016, the Defendant purchased a penphone jointly with E, by taking about about 10 grams concealed 10 grams from F located in the Suwon-si Line, Suwon-si, Suwon-si, Suwon-si, and dividing 5 grams into Helphone in Suwon-si, Suwon-si, Suwon-si, Suwon-si.
3. On February 9, 2016, the Defendant injected approximately 0.08g of phiphonephones purchased as set out in the foregoing 2.2. The Defendant injected phiphones into arms with a single-use injection device.
4. On May 20, 2016, the Defendant administered chophones by inserting approximately 0.08g of chophones at Jururura located in Busan, Busan, on May 20, 2016, and inserting approximately 0.08g of chophones into arms using a single-use injection device.
5. On May 24, 2016, the Defendant administered chophones by taking approximately 0.08g of chophones into arms at the Defendant’s residence in Gwangju City, K and 203, and by using chophones for a single-use injection.
6. On May 30, 2016, the Defendant administered chophones by heating approximately 0.08 grams in the guest rooms of M Hotel L in Songpa-gu Seoul, Songpa-gu, and raising the postponement thereof, around May 30, 2016.
7. On May 30, 2016, the Defendant around 14:20, at the guest room of the above MM MM No. 301, approximately 0.29g of phiphonephones, inside the border line, and approximately 6.79g of phiphonephones.
