A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

As a result, the Defendant driven the said car in a state where it is difficult to drive the car normally due to the influence of drinking, and thereby, suffered the victim's scam and scambling in need of treatment for about two weeks.

2. The Defendant violated the Road Traffic Act (non-compliance with the drinking test) at the above time and at the above place, and there were reasonable grounds to recognize that he was driving under the influence of alcohol, such as drinking and smelling, etc., by driving the said car at the above time and at the above place, from the slopeF belonging to the Busan Jin Police Station Epis, which caused the traffic accident, and was demanded to comply with the drinking test by inserting approximately 20 minutes of the drinking meters into a drinking measuring instrument.

Nevertheless, the Defendant, by means of not inserting the whole in a breath measuring instrument properly, failed to comply with a police officer’s request for a measurement of drinking without justifiable grounds.
