1. The defendant shall be punished by imprisonment with prison labor for one and half years;

2.Provided, That the above sentence shall be executed for a period of three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant violated the Punishment of Violences, etc. Act (a collective action, deadly weapons, etc.) is a person operating a real estate consulting company under the trade name of “C”, and when the victim D (the age of 38) introduced the victim E (the age of 46) to enter into a contract for the construction of a building with D and E. The victim D deposited the construction cost in the name of F construction represented by the victim E, and received money by threatening the victims who did not pay money to the Defendant.

피고인은 2014. 8. 29. 08:30경 성남시 수정구 G에 있는 ‘H’에서 피해자 D, 피해자 E과 공사 대금 문제 등으로 말다툼하던 중, 순간적으로 격분하여 위험한 물건인 가스분사기를 꺼내어 위 피해자들에게 겨누며 “한마디만 하면 쏴버린다. 언능 8,000만원을 찾아와라”고 겁을 주고, 이에 겁을 먹은 피해자 E으로부터 피고인의 아들 I 명의의 계좌로 2회에 걸쳐 합계 10,000,000원을 교부받아 이를 갈취하였다.

2. 총포ㆍ도검ㆍ화약류등단속법위반 피고인은 분사기(킹코브라, 허가번호-J)의 소지허가를 받은 사람으로서, 전항의 일시, 장소에서 전항의 기재와 같이 분사기를 D, E에게 보이며 쏴버리겠다고 협박하여 금원을 갈취하는 등 분사기의 소지허가 용도인 호신용 외 범행의 목적으로 분사기를 사용하였다.
