Punishment of the crime

The Defendants related to this 2019No-1277 operated the Internet shopping mall site (C, D), and conspired to acquire money by receiving money as the price for goods from those who have contacted to purchase electronic equipment by putting a false writing, such as selling electronic equipment, on the said shopping mall site.

피고인들은 2019. 3. 21. 통영시 E건물 F호에서 위 쇼핑몰 사이트에 ‘에어팟을 판매한다’는 취지의 글을 게시하고, 이를 보고 연락한 피해자 G에게 “149,150원을 입금하면 에어팟 정품을 배송해주겠다.”라는 취지로 거짓말을 하였다.

그러나 사실은 피고인들은 에어팟 등을 실제로 가지고 있지 않았고, 대금을 받게 되더라도 애초에 에어팟을 보내줄 생각 없이 그 대금만을 피고인들이 개인적으로 사용할 생각이었기 때문에 피해자에게 에어팟을 보내줄 의사나 능력이 없었다.
