Reasons
1. Basic facts
A. The parties’ status Y is a stock company engaged in the business of issuing, selling, and managing credit cards, pre-paid cards, and the defendant is a stock company incorporated by financial institutions jointly with each other, which runs the business of credit inquiry and credit investigation as prescribed by the Use and Protection of Credit Information Act.
The plaintiffs have entered into a contract for use and financial transaction with Y and used or used credit cards, etc. from them.
B. The concept of the card accident analysis system and the introduction card accident analysis system (hereinafter “FDS”) are introduced by all domestic card companies as a system to detect abnormal or fraudulent use due to theft, loss, forgery, etc. of credit cards. According to FDS, it is necessary to establish an analysis model based on statistical techniques by utilizing large-scale card use information and pertinent customer information based on past accident transactions and based on the results, if it is discovered that abnormal types of transactions have occurred according to the accident pattern analyzed in the course of using credit cards.
C. On January 30, 2013, Y entered into a contract with the Defendant for the FDS development services and for the supply of card customer information, Y on January 30, 2013, Y concluded a contract with the Defendant for the purchase of FDS business by setting the contract amount of KRW 227,419,50, and within seven months from the date of the delivery due date.
