The defendant's appeal is dismissed.

1. The decision of the court below on the gist of the grounds for appeal is too unreasonable.

2. It is recognized that the Defendant made a confession of all the facts charged and reflects on the confession of all the facts charged, and that the Defendant paid 10 million won out of 45.2 million won to the victim.

However, considering the remaining amount of damage, the following factors, such as the defendant's age, sexual conduct, family environment, the background and result of the crime of this case, and the following circumstances, the court below's punishment is too excessive and unfair. Thus, the defendant's above assertion is without merit.

3. Accordingly, the defendant's appeal of this case is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the defendant's appeal of this case is without merit. It is so decided as per Disposition.
