1. The Defendant’s KRW 40,000,000, and its annual rate from June 10, 2009 to June 13, 2019, respectively, to the Plaintiff.

2. Judgment without holding any pleadings: Articles 208 (3) 1 and 257 of the Civil Procedure Act.

Since the provisions on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Partial Dismissal Lawsuit (hereinafter “Promotion Act”) were promulgated on May 21, 2019 and enforced from June 1, 2019, the statutory interest rate under the Promotion Act was 12% per annum from June 1, 2019, it is recognized only as damages for delay calculated at the rate of 12% per annum from June 14, 2019, and the exceeding portion of the claim is dismissed.
