A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 공무집행 방해 피고인은 2017. 9. 29. 03:35 경 경남 합천군 C에 있는 합 천 경찰서 D 파출소에서 술에 취한 채 소란을 피우던 중 위 D 파출소 소속 경위 E, 경위 F으로부터 술이 취했으므로 소란을 피우지 말고 귀가하라는 요청을 받았다는 이유로 화가 나, 위 경찰관들에게 “ 씹할 놈 아, 개 자슥 들아 ”라고 욕설을 하며 오른손 주먹으로 위 F의 좌측 얼굴 부위를 1회 때려 바닥에 넘어지게 하고, 계속하여 같은 날 03:40 경 위와 같은 이유로 현행범인 체포된 후 갑자기 위 파출소 소속 경사 G의 배 부위를 발로 2회 걷어 차 폭행하였다.

Accordingly, the defendant interfered with the legitimate execution of duties of police officers on the prevention of crimes and maintenance of order.

2. At around 03:35 on the same day, the injured Defendant left the left-hand side of the victim F in the same manner at the above place, and put the victim into an influence of the treatment days to the left-hand side of the treatment days.

1. Article 136 (1) of the Criminal Act (the point of obstructing the performance of official duties) and Article 257 (1) of the Criminal Act concerning facts constituting an offense;

1. Articles 40 and 50 of the Criminal Act of the Commercial Concurrent Crimes. Article 50 (Inter-Korean Crimes of Obstructing and Inflicting in the Execution of Official Duties to F)

1. Selection of each sentence of imprisonment;

1. The former part of Article 37 of the Criminal Act, and Articles 38 (1) 2 and 50 of the same Act, which aggravated concurrent crimes;

1. Article 62(1) of the Act on the Suspension of Execution (the fact that the defendant recognized his mistake and reflecteds his mistake, and the police officer in the injured person wanted to find the Defendant’s wife.
