Defendant shall be punished by a fine of KRW 1,000,000.

If the defendant does not pay the above fine, 100,000 won shall be one day.

Punishment of the crime

The Defendant is a person registered as a preliminary candidate for the 7th local election of the members of the D military unit, which was implemented on June 13, 2018 as the chairperson of the school operation of C Middle Schools located in Chungcheongbuk-do, and is in a post-election relationship with E that registered as a preliminary candidate. The election campaign period for the above election is from May 31, 2018 to June 12, 2018.

No one shall carry out an election campaign for members of an educational, religious or professional institution or organization using any occupational act in the organization thereof, and no one shall carry out an election campaign by means of propaganda facilities or tools, various printed matters, broadcasting, newspapers, news communications, magazines, other publications, campaign meetings, debate meetings, debate meetings, native folks meetings, alumni meetings, neighbors' meetings, other meetings, information and communications, the establishment of an election organization or private organization, door-to-door visits, or other methods, except as otherwise provided for in the Public Official Election Act, prior to the election period.

On April 19, 2018, at around 18:50, the Defendant met E that campaigned in front of the Chungcheong F Office on the road. On the same day, the Defendant expressed his mind to conduct an election campaign against the participants at meetings, such as Cmiddle School school school operating committee, which will be held on the same day, and informed E of the gathering’s place where Cmiddle school parents operating committee members, etc. reach a meeting.

At around 19:10 on April 19, 2018, the Defendant complained of support for the duties of the commission, including 25 persons, such as C secondary school parents management committee members, who are educational organizations, in the H restaurant located in Chungcheongbuk G, on the spot, and as E visits to the above restaurant, “I veves. Accordingly, the defendant carried out an election campaign before the election campaign period, and carried out an election campaign by using official activities within an educational organization.
