1. Basic facts

A. (1) The Plaintiffs are married couple, and the Defendant is a juristic person operating an insurance business under the relevant Acts and subordinate statutes such as the Insurance Business Act.

on January 26, 2004, Plaintiff A entered into a non-payment franchise health insurance contract (contract number C) with the Defendant as the insured and paid the insurance premium. Plaintiff B entered into a non-payment franchise contract (contract number D) with the Defendant on February 10, 2004 and paid the insurance premium (hereinafter collectively referred to as “instant insurance contract”). The insurance contract of this case includes a special agreement for the guarantee of hospitalization. The content of the insurance contract of this case is 10,000 won per day exceeding 3 days if the contract continues to be four days due to nine or more days. The nine diseases refer to “patherter, heart disease, high-tension, high-tension, cerebrovascular disease, chronic respiratory disease, chronic smoking disease, chronic liver disease, traxial disease, traxial disorder, and new trawal disorder, etc.”

B. The Plaintiffs received hospitalized treatment under the following name:
