The defendant shall be innocent.

Indictment

1. A person eligible to receive subsidies for discontinuance of business pursuant to the Special Act on Assistance to Farmers, Fishermen, etc. following the Conclusion of Free Trade Agreements (Enforcement by Act No. 7207 of Apr. 1, 2004) is limited to the farmers, etc. who continue to own the surplus of the production of the relevant item since before May 24, 2004, which is the date of the public notice of the eligible item for subsidies for discontinuance of business. C purchases an orchard7,434 square meters and a size of 14, 203.

Although completing the registration of ownership transfer under one’s name, in fact, while residing in Seoul after the purchase of the said orchard and leaving the said orchard unattended alone, the said orchard could not be eligible for subsidies for discontinuance of business under the said Special Act.

Despite the fact that the Defendant owned 1/2 of the above orchard and owned neighboring land, it was well aware that the above orchard could not be eligible for support for discontinuance of business pursuant to the above Special Act. However, upon sending consent for closure of business to C around July 2004, the Defendant contacted C with the possibility of receiving support for closure of the above orchard, and received consent for closure of business and a certificate of personal seal from C. At the time of Seopopopopopo City Office of Seopopopo City, Seopopopo City, the Defendant made an application for the payment of support for closure of the above orchard along with E, and submitted the “application for the payment of support for discontinuance of business in the field of agriculture,” stating the false contents as if the above orchard was produced in the above orchard from before the date of the notification of the target item for support, and the public official in charge of production and closure of the above orchard before the date of the local confirmation of the public official on August 4, 2006 shall be in charge of production of the above target item and the certificate of personal seal.
