1. As to KRW 59,162,40 and KRW 42,150,40 among the Plaintiff, Defendant C shall be from September 10, 2015 to November 19, 2015.
Reasons
1. Basic facts
A. The status of the parties is a business entity that manufactures semiconductors, precision parts, and wholesale and retail business with the trade name of “D”. Defendant C is a person who runs manufacturing and wholesale business of electronic applied processing machinery, etc. under the trade name of “E” after completing business registration under the name of Defendant B.
나. 이 사건 계약 체결 등 원고는 2012. 11. 21. 및 2013. 5. 7. 피고 C과 사이에, 피고 C이 원고에게 갠트리로더(GANTRY LOADER, 이송자동로봇), 인스토커, 아웃컨베어 등 자동차 부품 생산설비의 자동화 사업에 필요한 자동화 기계(이하 ‘이 사건 기계설비’라 한다) 2대를 대금 42,150,400원(부가가치세 포함, 이하 같다)에 공급하기로 하는 내용의 계약(이하 ‘이 사건 계약’이라 한다)을 체결하고, 피고 C에게 이 사건 기계설비 대금 명목으로 2012. 11. 21. 8,580,000원, 2013. 5. 7. 10,000,000원, 2013. 5. 9. 10,000,000원, 2013. 10. 31. 2,770,400원, 2013. 12. 21. 2,800,000원, 2014. 1. 13. 8,000,000원 합계 42,150,400원을 송금하였다.
C. After the conclusion of the instant contract, Defendant C did not complete the obligation to manufacture and install the instant machinery and equipment even from September 2014, and the Plaintiff demanded the Plaintiff to return the price of the instant machinery and equipment and compensate for damages. Accordingly, Defendant C wishes to provide the Plaintiff with the design and technology, etc. of the instant machinery and equipment as ordered by Defendant C. Accordingly, if the Plaintiff manufactured and supplied the instant machinery and equipment to the customer instead of Defendant C, it would pay the Plaintiff KRW 700,000 per unit of the instant machinery and equipment, KRW 100,000,000 for assembly and installation costs, and KRW 10% for the purchase price of the parts (hereinafter “instant agreement”).
(2) According to the instant agreement, the Plaintiff manufactured and supplied the instant machinery and equipment to various business partners who requested Defendant C to manufacture the instant machinery and equipment.
