The defendant shall pay 26,045,065 won to the plaintiff and 14.9% per annum from November 3, 2020 to the day of complete payment.

1. Facts of recognition;

A. On January 26, 2018, the Defendant borrowed KRW 50,000,00 from D Co., Ltd. (hereinafter “D”) at the loan rate of 60 months, interest rate of 11.9% per annum, and delayed interest rate of 14.9% per annum.

B. The Defendant did not perform its duty to repay the principal and interest of the loan and thereby lost the benefit of time.

C. On June 12, 2020, the Plaintiff received the claim against the Defendant from D and notified the Defendant of the fact of transfer on the 16th of the same month.

As of November 2, 2020, the principal and interest of loans to be paid by the defendant as of November 2, 2020 reaches KRW 26,045,065.

9. Each entry of 10 evidence and the purport of the whole pleadings;

According to the above facts of determination as to the cause of the claim, the defendant is obligated to pay to the plaintiff the interest rate of KRW 26,045,065 as well as delay interest rate of KRW 14.9% per annum from November 3, 2020 to the date of full payment after the base date to the date of full payment.

3. The plaintiff's claim for conclusion is reasonable, and it is so decided as per Disposition.
