Reasons
Punishment of the crime
1. No person, other than a pharmacist, may establish a pharmacy;
Nevertheless, Defendant A, who is not a pharmacist, entered into a real estate lease contract under the name of Defendant B, and registered the establishment of a pharmacy in the name of Defendant B. Defendant B agreed to receive a certain monthly amount every month as the price for the above act and the salary for the performance of duties as a pharmacist. Defendant A, who is not a pharmacist, agreed to establish and operate a pharmacy by forming the appearance of Defendant B, as if the pharmacy was established.
Accordingly, from December 24, 2004 to February 22, 2015, the Defendants equipped with the pharmacy facilities such as a dispensary, etc. from J 1 to 64.06 square meters, and applied for registration of the establishment of a pharmacy in the name of Defendant B to the competent authority. Defendant B is gradually paid KRW 5 million per month while working as a pharmacist at the above pharmacy, and Defendant A is paid KRW 7 million every month. Defendant A established and operated a pharmacy by operating the above pharmacy in a substantial manner, and acquired KRW 26,49,585,631 in total as care benefit.
2. No person, other than a pharmacist, may establish a pharmacy.
Nevertheless, the Defendant, other than a pharmacist, concluded a real estate lease contract in the name of L who is a pharmacist and registered the establishment of a pharmacy in the name of L. L. The Defendant, other than a pharmacist, agreed to receive a certain amount of money every month as the price for the above act and the salary for the performance of duties as a pharmacist, and formed the appearance of L.C. pharmacy as if L. established the pharmacy
Accordingly, the Defendant is equipped with L and a pharmacy facilities from January 31, 201 to September 2, 2013, with a size of 88.06 square meters from the 1st floor of Nam-gu Incheon Metropolitan City, Nam-gu, Incheon, and filed an application for registration of the establishment of a “N pharmacy” in the name of L with the competent authority, and L is at the same pharmacy.
