A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

"2018 Highest 2684" was a person who operated C in Jeonnam Bosung-gun B, and the victim (owner)D and E entered into an entrustment contract with the defendant to supply the cell phone owned by them to the defendant and let the defendant sell them.

1. Occupational embezzlement;

A. A. On October 10, 2017, the Defendant: (a) around March 2017, at the above C, kept a cell phone of the amount of KRW 79,700 (700) equivalent to the market value of the victim, which was entrusted by the Dispute Settlement Bank D, for the victim; (b) around March 2018, the Defendant: (c) placed the said cell phone as mortgage on the G 1st floor H located in Gwangju Mine-gu; (d) received cash, the amount of which is unknown; and (e) arbitrarily disposed of the total amount of KRW 44,243,100 (1) from September 19, 2018, the total market value of the victim’s possession until September 19, 2018.

B. On March 29, 2018, the Defendant: (a) at the victim’s expense, at the above C, sold by the victim (“E”); (b) at the victim’s expense, the Defendant left the aforementioned mobile phone as mortgaged property in order to fully repay the debt-backed eight mobile phone loss incurred while the Plaintiff was in the course of business on behalf of the victim; (c) received the cash, the amount of which is unknown; and (d) disposed of at will seven mobile phones equivalent to the total market value of the victim’s possession from September 7, 2018 to September 7, 2018, such as the list of crimes (2).

Accordingly, the Defendant embezzled the property of the victims who kept on duty as above.

2. On December 12, 2017, the Defendant may purchase a mobile phone to the victim L at K located in the J of the Net City of 20:00 on December 12, 2017.

If a mobile phone is purchased in cash, the purchase of a mobile phone on credit;

If it is possible to get a lot of profits, it is 30% of profits by selling mobile phones.
