1. Defendant B is at the rate of 15% per annum from April 5, 2016 to the date of full payment to the Plaintiff.
Reasons
1. Summary of the plaintiff's assertion
A. On September 3, 2015, the Plaintiff entered into a contract with the Defendants for the lease of a motor vehicle with the name of “D” (1) around KRW 2 million, monthly rental fee of KRW 470,000,000, monthly rental fee of KRW 4700,000, and the period from September 3, 2015 to December 5, 2015; (2) around November 10, 2015, the Plaintiff made a contract with the Defendants for the lease of a motor vehicle with FelF (hereinafter referred to as “LF”); and (3) concluded a contract with the Defendants for the lease of a motor vehicle with the police during the period from November 10, 2015 to December 5, 2016, each of which the Defendants reported to be leased a motor vehicle with the Defendants without permission.
As a result, the Plaintiff suffered not only damages from the failure to use each of the above automobiles for one month, but also damages from the loss of each of the goods and money (hereinafter “each of the goods and money of this case”) in the attached Table 1 of the total amount of KRW 10 million stored in each of the above automobiles. Since then, each of the above lending contracts terminated after the lapse of the period.
Therefore, the Defendants are jointly and severally obligated to pay to the Plaintiff the deposit amount of KRW 4 million (=2 million won), the amount equivalent to the unjust enrichment of KRW 9.4 million for a month (= KRW 4.7 million), the amount equivalent to KRW 10 million, and the amount of damages equivalent to KRW 10.6 million, and the amount of damages equivalent to KRW 5 million for mental suffering suffered by the Plaintiff due to the above theft, etc., and the amount of consolation money of KRW 5 million for mental suffering suffered by the Plaintiff.
B. On October 2, 2015, the Plaintiff entered into a contract with the Defendants via Defendant B to obtain a long-term lease of IMW X-4 automobiles (hereinafter “X4 automobiles”) at KRW 18.7 million per month and monthly rent of KRW 600,000,000.
