B. Defendant Housing City Guarantee Corporation is 1) Defendant Corporation.

1. Facts of recognition;

A. The Plaintiff is an autonomous management organization that consists of occupants in order to manage A apartment in the Dong-gu, Busan (hereinafter “instant apartment”) 313 households.

2) Defendant B is the seller of the instant apartment, and Defendant C is the contractor of the instant apartment, and Defendant C is the contractor of the instant apartment, and Defendant C is the guarantor who entered into a warranty contract with Defendant B and C on defect repair guarantee for the instant apartment.

The Intervenor D Co., Ltd.’s subsidiary D Co., Ltd. is the company manufacturing and installing the elevator of the instant apartment.

B. The instant apartment that approved the use of the instant apartment was approved by the competent authority on December 26, 2016, and the sectional owners of the instant apartment began to move into the instant apartment since that time.

On December 7, 2016, Defendant B, and C Co., Ltd. entered into a warranty contract for repair of defects between the Defendant Housing and Urban Guarantee Corporation and the Defendant Housing and Urban Guarantee Corporation with respect to the instant apartment as “Defendant B, C Co., Ltd., and the obligee,” and were issued a warranty bond for repair of defects as follows:

The special clause of the warranty warranty clause of this case is the change to the representative meeting of the guaranteed creditor under Article 41(3) of the Enforcement Decree of the Multi-Family Housing Management Act when the representative meeting of occupants is organized.
