1. The defendant,
A. The Plaintiff A with respect to the amount of KRW 46,953,785 and KRW 10,970 square meters in Jinju-si from April 4, 2017.
Reasons
1. Facts of recognition;
A. On March 19, 2009, the non-party Dongdong Co., Ltd. (hereinafter “non-party Co., Ltd”) completed the registration of ownership transfer on the land of 10,970 square meters in Jinju-si (hereinafter “instant land”).
B. On January 3, 2014, upon Nonparty 1, who was the right to collateral security, Nonparty 1’s application, Nonparty 2, the right to collateral security, rendered a voluntary decision to commence the auction on the instant land as Jinyang Agricultural Cooperative D with the Changwon District Court Jinyang Branch Branch Branch D, and on January 6, 2014, the registration of the voluntary decision
(hereinafter referred to as “land auction procedure”). C.
The Plaintiffs received sale of the instant land at the auction procedure and paid the price on June 3, 2014, and on the same day, Plaintiff A completed the registration of ownership transfer as to 7/10 of the said land, and Plaintiff B completed the registration of ownership transfer as to 3/10 of the said land.
The registration of preservation of ownership was completed in the name of the non-party company on May 22, 2014, on the non-party company's 1,495.06 square meters for 1,495.06 square meters for 1,495.06 square meters for 2nd general steel structure in Jinju-si, which was constructed on the land of this case.
E. On July 23, 2014, upon the application of Nonparty E, Nonparty E, the creditor, the Seoul District Court was rendered a ruling of compulsory commencement of compulsory commencement of each of the factories of this case, and on July 24, 2014, the registration of compulsory commencement of compulsory commencement of auction was completed with respect to each of the factories of this case. On October 28, 2014, upon the application of the plaintiffs who are creditors, the decision of compulsory commencement of auction was rendered on October 28, 2014, and on the same day, the registration of compulsory commencement of auction was completed on each of the above factories.
(f) Nonparty H is a factory.
