Reasons
Punishment of the crime
[criminal history] On February 12, 2007, the Defendant received a summary order of KRW 1.5 million for a violation of road traffic law (drinking) at the Daejeon District Court. On June 19, 2017, the Defendant received a summary order of KRW 2 million for the same crime in the same court.
[Criminal facts]
1. No person who violates the Guarantee of Automobile Damage Compensation shall operate a motor vehicle without mandatory insurance;
Nevertheless, the Defendant, on July 24, 2020, operated E 108C 108C obaba under the condition that he was not covered by mandatory insurance from around 11 km to the front road located in Seo-gu Daejeon Daejeon, Daejeon to the front road in Seo-gu, Daejeon.
2. Violation of the Traffic Act on roads.
A. On July 24, 2020, the Defendant, without a license, driven a motor bicycle driver’s license on July 24, 2020, without obtaining a motor device bicycle license from around 17:40 on July 24, 2020, from around 11 km to the front road located in Daejeon Seo-gu Daejeon Seo-gu, Daejeon (Seoul).
B. On July 26, 2020, the Defendant, without obtaining a driver’s license on July 26, 2020, driven a motor bicycle driver’s license for around 15:40 on July 26, 2020, with approximately 4.3 km from the front road of the bus vehicle in the Daejeon Seo-gu and the Dong to the front road located in the same Gu F.
3. On July 26, 2020, the Defendant was under the influence of alcohol leveling 0.066% from blood alcohol leveling around 15:40 on July 26, 2020, the Defendant driven a bus vehicle in the Daejeon Seo-gu and the Dong-dong from around 0.06% on the road in front of the bus vehicle notice in the Daejeon Seo-gu to the G road located in the same Gu F to about 4.3 km on the road in front of the same Gu.
Accordingly, the Defendant violated the prohibition of drinking alcohol driving regulations not less than twice.
