1. The Defendant’s monthly support to the Plaintiff is based on the Decision 2013Kadan114 Decided February 12, 2014.
Reasons
1. Facts of recognition;
A. On November 7, 1998, the Plaintiff completed the registration of transfer of ownership in his name on the ground of sale with respect to the land of 793 square meters and D 208 square meters (hereinafter “each of the above real estates”) in Gangwon-gun, Gangwon-do.
B. The Defendant owns a wooden building on each of the instant real estate (hereinafter “instant building”). The instant building is located on the ground of 793 square meters in order to connect each point of (i) the attached Table No. 2, 3, 23, 22, 21, 20, 19, 18, 17, 17, and 22, 22, 22, 20, 22, 20, 20, 18, 17, and 208 square meters in parallel, among the area No. 22, 23, 25, 21, and 22 of the aforementioned drawings, among the area No. 139 square meters in the ship and the area No. 208 square meters in lots, among the area No. 793 square meters in the ship and the area No. 22,3,23,223,21,20, 201, 225, 17 and 25.
However, while the lawsuit of this case is pending, the Plaintiff completed the registration of ownership transfer on the building of this case.
C. On February 12, 2014, the Defendant was sentenced to the judgment below (hereinafter “instant judgment”) on February 12, 2014, in the case of Youngcheon District Court Young Branch Branching 2013Kadan114, which claimed removal, etc. of the instant building against the Plaintiff.
1. The plaintiff is the defendant,
(a) Removal of a wooden building on the ground located on the part (i) of 139 square meters in the ship and the part of 22,23, 25, 21, 22, 20, 18, 17, and 2 of the attached Table 2, 3, 23, 22, 22, 21, 20, 19, 18, 17, among the area of 793 square meters in order among the areas of 793 square meters in the 793 square meters in the static-gun of Gangwon-do, Gangwon-do, which is located on the part (ii) of 139 square meters in the ship and the part (i)
B. Of the land size of 793 square meters in Gangwon-do, the above map is one of the area of 155 square meters inboard (i) and the area of 208 square meters in order to connect each point of the attached Table 2, 3, 23, 22, 21, 20, 20, 19, 18, 17, and 2,000 square meters in order.
