피고인은 2015. 3. 16. 14:40경 경북 의성군 B에 있는 의성군 소유 임야 내에 있는 망모(亡母) 묘지에서 산불에 대한 아무런 예방조치 없이 소지하고 있던 플라스틱 라이터로 촛불을 켜고 제를 지내던 중, 촛불이 묘지 잔디에 넘어져 바람에 의해 불길이 산 위쪽으로 확산되면서 산불이 발생하여 피해면적 0.8ha(약 2,420평)에 생립한 평균수고 10m, 가슴높이 지름 16cm 되는 아카시아나무, 참나무, 소나무 등 640본, 차재적 55.04㎥의 입목을 소훼하여 조림복구금액 4,457,000원 상당의 산림피해를 발생하게 하였다.
