A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

On July 13, 2020, the Defendant, around 23:34, 2020, caused a traffic accident involving the vehicle ahead of it while driving CMW530d GT car while drinking alcohol on the front of the Incheon Bupyeong-gu, Incheon.

Since then, D, the other party driver, reported 112 to the effect that “the driver of the other party is suspected of driving under the influence of alcohol on the vehicle,” and around 00:05 on July 14, 2020, the Defendant, upon receiving the above report, tried to leave his own site to ask for cooperation in the measurement of drinking alcohol due to considerable reasons to suspect drinking, such as smelling from E of the Incheon Bupyeong Police Station and the police officer belonging to the same police station, who called the scene after receiving the report, and drinking out from E of the police officer belonging to the same police station, and attempted to stop the above police officer’s own site, and prevented the Defendant from leaving the scene, and assaulted the above police officer on his own hand, continuing to arrest the Defendant as a flagrant offender, and threatened him by threatening him, a police officer belonging to the same police station, who moved to the patrol vehicle.

Accordingly, the defendant interfered with the legitimate execution of duties by police officers concerning the handling of 112 reported cases.

The Defendant of the Incheon Bupyeong-gu Incheon Bupyeong-gu 23:30 on July 14, 2020, the Defendant: (a) while driving a cW 530d GT car while drinking on the front side of the Incheon Bupyeong-gu B on July 14, 2020; (b) was unable to comply with the demand of a police officer for the measurement of alcohol at around 23:50 on the same day on the same day on the ground that there are reasonable grounds to recognize that he/she was driving under the influence of alcohol, such as a vehicle accident that occurred while driving the cMW 530d GT car while receiving the report, while driving the cM 530d GT car, and divided the body into the face F, and without justifiable grounds, he/she was required for the measurement of alcohol at around 23:50 on the same day; and (c) failed to comply with the demand of a police official for the measurement of alcohol at around 0:05 on the following day.
