A Imprisonment with prison labor of one year and six months, Defendant B shall be punished by imprisonment with prison labor of one year, Defendant C, D, and E, respectively.

Punishment of the crime

The Defendants of the 2017 Gohap 29 are the workers belonging to the upper team, who export and import industrial products and agricultural products, entering the territory of the Republic of Korea and China’s annual attitudes.

1. When a person intends to import goods, he/she shall report to the head of a customs office the name, standard, quantity and price of the goods concerned, and other matters prescribed by Presidential Decree;

On January 4, 2017, the Defendant: (a) concealed ten gold bars (10,183,320g of the cost of goods) of an amount equivalent to KRW 100,429,930 (66,183,320 of the cost of goods) at the market price, and attempted to go in without filing a report thereon with the customs collector, while entering the port of Pyeongtaek-si at the port of 75, Pyeongtaek-si, Pyeongtaek-si, Pyeongtaek-si, Pyeongtaek-si; (b) attempted to go in without filing a report with the customs collector; and (c) attempted to go in the course of examining the personal effects of police officers.

2. Where a person intends to import goods, he/she shall report to the head of a customs office the name, standard, quantity and price of the goods concerned, and other matters prescribed by Presidential Decree;

On January 4, 2017, the Defendant: (a) concealed eight gold bars (1,60g) of an amount equivalent to KRW 80,711,160 at the market price (53,188,650 at the cost of goods) in the Defendant’s resistance while entering the port of Pyeongtaek-si Port at 75, Pyeongtaek-si, Pyeongtaek-si, Pyeongtaek-si; (b) and attempted to go in without filing a report with the customs collector; and (c) attempted to go in the process of inspecting the personal effects of police officers; and (d) attempted to go into the port without filing a report with the customs collector; (e) attempted to go in the process of inspecting the personal effects of police officers.

3. When a person intends to import goods, he/she shall report to the head of a customs office the name, standard, quantity and price of the goods concerned, and other matters prescribed by Presidential Decree.

On January 4, 2017, the Defendant entered the port of Pyeongtaek-si Port 75, Pyeongtaek-si, Pyeongtaek-si, Pyeongtaek-si, Pyeongtaek-si. 7 gold bars (1,393.20g) equivalent to KRW 70,082,130 (cost of goods 46,184,120) at the market price, within the Defendant’s resistance.
