The defendant's appeal is dismissed.
Reasons
1. The summary of the grounds for appeal (unfair sentencing) by the lower court (five years of imprisonment) is too unreasonable.
2. The judgment of the defendant recognized each of the crimes of this case and reflects the fact that each of the crimes of this case was established first, and the relationship between the crime of this case and the concurrent crimes of the latter part of Article 37 of the Criminal Act should be considered at the same time with the case where the judgment is held. The defendant wants the defendant's wife in the course of the victim'sO and investigation, and some of the victims recovered the damaged items.
On the other hand, the defendant committed each of the crimes of this case against many victims even though he had the history of committing the same kind of crime several times, and the quality of the crime is not very good, and the amount of fraud by each of the crimes of this case exceeds 1 billion won in total, and most of the crimes do not recover from damage.
In full view of the above circumstances and the facts that there are no special circumstances or changes in circumstances that may be newly considered after the pronouncement of the lower judgment, all of the factors indicated in the arguments in the instant case, such as the Defendant’s age, sex, environment, family relationship, motive for committing a crime, means and consequence of a crime, and the scope of recommended sentences based on the sentencing guidelines established by the Supreme Court sentencing committee, the sentence imposed by the lower court is too unreasonable as it is too unreasonable.
3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the defendant's appeal is without merit. It is so decided as per Disposition.
