1. The Defendant’s KRW 68,496,856 as well as the Plaintiff’s KRW 5% per annum from January 31, 2015 to April 27, 2017.

1. Facts of recognition;

A. The non-party LG EECTRONS INC (hereinafter “ELB”) concluded a contract with the non-party ELBS INC (hereinafter “LG”) located in the Republic of Korea for exporting 50 metric tons of LTV and monitoring parts (hereinafter “the instant cargo”) to USD 68,793.33.

B. The instant cargo was scheduled to be transported by Nonparty 1, the actual carrier of Nonparty 1 through Nonparty 1, through Nonparty 2, by MSDDERN SPING COPY (hereinafter “mC”). On January 30, 2015, ELE: (a) delivered a container on which the instant cargo was loaded (TMU6904130; hereinafter “instant container”) to the Defendant, who is a domestic company operating the port terminal operation business; and (b) the Defendant stored the instant container in its container open port (CY).

C. On January 31, 2015, the instant container, which was kept in the Defendant’s open container storage room, was caused by an accident that falls and falls on the ground from the height of the five onloads to the ground (hereinafter “instant accident”). The instant cargo was destroyed by the shock, thereby causing damage equivalent to US$ 63,145.70.

E. The Plaintiff is an insurer who entered into a cargo insurance contract with ELI for the instant cargo, and the Plaintiff paid the insurance amount of USD 69,460.27 to ELI, the insured, for the damage incurred to the instant cargo due to the instant accident.

F. On January 30, 2015, around the date of the instant accident, the exchange rate of the won per US$ 1 US dollars is KRW 1,095.70.
