피고인은 2018. 4. 일자 불상의 금요일 오후 위 태권도학원에서, 원생들을 두 팀으로 나누어 피구 경기를 진행하면서 네트 옆에 앉아서 심판을 보던 중 제일 먼저 퇴장당한 피해자 C(가명, 여, 10세)이 피고인의 왼쪽 옆으로 다가와 앉자, 갑자기 피해자의 등에 왼팔을 두르면서 왼손을 피해자의 왼쪽 겨드랑이에 집어넣고 손가락으로 피해자의 젖꼭지 부위를 3회 가량 문질러 피해자를 강제로 추행하였다.
