Reasons

1. Basic facts

A. The defendant is a non-corporate body established to promote the new construction and sale of apartments of a regional housing association in Busan Young-gu C, which consists of members recruited for the new construction and sale of the above apartment, but has not obtained the authorization of establishment of a regional housing association from the competent authorities up to now.

B. On July 12, 2016, the Plaintiff entered into a contract with the Defendant to join the regional housing association (hereinafter “instant contract”) as follows.

Article 10 (Expenses for Consulting Services for Cooperative's Support) ① Information Services for Cooperative's Support is KRW 12,100,000 per union member's household ( KRW 12,100,000) and is included in value-added tax.

(2) The consulting service cost for supporting the affairs of unions shall be the service cost for vicariously supporting the affairs and proceeding with respect to overall affairs of the Defendant, paid separately on the designated date and account by Section B, and the time and amount of payment of the consulting service cost for supporting the affairs of unions shall be as follows:

First service cost: KRW 8,00,000 in daily gold, KRW 2,000 in daily gold (including consulting service cost of a cooperative), KRW 30,000 in daily gold, and KRW 4,100,000 in annual gold, and KRW 30 days after the contract is concluded (including consulting service cost of a cooperative), and KRW 40,000 in the event the contract is terminated before the contract is cancelled, the contract is terminated, the consulting service cost of a cooperative already paid is waived, and the return is not required.
