The judgment of the court below is reversed.

A defendant shall be punished by imprisonment for not less than eight months.

1. The summary of the grounds for appeal dismissed the assertion of mistake of facts on the second trial date.

The sentence of the lower court (eight months of imprisonment) is too unreasonable.

2. 직권판단 피고인의 항소이유에 관한 판단에 앞서 직권으로 살피건대, 검사는 당심에 이르러 공소사실 제2항의 “피고인은 위 일시경 혈중알코올농도 0.170%의 술에 취한 상태로 자동차 운전면허 없이 경기 여주시 가남읍 소재 네오시스 주차장에서부터 같은 시 천송동 신륵사사거리 앞길에 이르기까지 약 10km 구간에서 위 B 아반떼 차량을 운전하였다.”를 “피고인은 위 일시경 혈중알코올농도 0.170%의 술에 취한 상태로 자동차 운전면허 없이 경기 여주시 오학동 소재 학소원장례식장에서부터 같은 시 천송동 신륵사사거리 앞길에 이르기까지 2.5km 구간에서 위 B 아반떼 승용차를 운전하였다.”로 변경하는 내용으로 공소장변경허가신청을 하였고, 이 법원이 이를 허가함으로써 그 심판대상이 변경되었으므로, 원심판결은 더 이상 유지될 수 없다.

3. Accordingly, the judgment of the court below is reversed pursuant to Article 364 (2) of the Criminal Procedure Act without examining the defendant's assertion of unfair sentencing, and the judgment below is again decided as follows through pleading.
