사행성 조장으로 인한 게임산업진흥에관한법률위반 게임물 관련 사업자는 경품 등을 제공하여 사행성을 조장하면 아니 됨에도 불구하고, 피고인은 2018. 2. 14.경부터 2018. 3. 10.경까지, 2018. 3. 23.경부터 2018. 6. 14.경까지 위 ‘D게임랜드’에서, 게임기의 버튼을 자동으로 눌러주는 속칭 ‘똑딱이’ 장치를 구비한 뒤 신서유기전 30대, 로스트킹덤 30대, 해적이야기2 30대 등의 게임기를 설치하고, 게임장을 방문한 불특정 손님들이 게임기에 10,000원을 투입하면 10,000포인트가 쌓여 그 포인트를 이용하여 각 게임이 자동으로 실행되게 하고, 우연한 결과에 따라 게임 화면 속 다섯 장의 카드에서 동일한 숫자가 연속되거나 동일한 무늬가 연속될 경우 점수를 획득하여 포인트를 쌓는 방법으로 손님들이 게임 포인트를 적립하게 하고, 적립된 10,000포인트 당 쿠폰 1장을 제공한 뒤 위 쿠폰을 환전할 수 있게 하여 해당 금액만큼 게임을 다시 할 수 있게 하는 등 쿠폰에 교환가치를 부여하였다.

B.
