1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On August 21, 2009, the Plaintiff obtained permission to collect earth and stones for a period of 65,615 square meters for three parcels outside Sejong Special Self-Governing City, E, and for three parcels outside Sejong Special Self-Governing City from August 21, 2009 to September 30, 2018.
B. On October 1, 2010, the Plaintiff entered into a contract with the FF Co., Ltd. (hereinafter “Defendant”) on the condition that the term of the contract is extended from October 1, 2010 to September 30, 2012 to the period of the contract, and that the Plaintiff has the right to supply and sell aggregate used or sold to the Defendant. On February 28, 2012, the Plaintiff entered into a contract with the Defendant for the change of the term of the contract with the terms of the said contract from February 1, 2012 to January 31, 2015.
C. On April 29, 2013, the Plaintiff entered into an amendment agreement with the Defendant to add the following to the said aggregate trading (sale right) agreement:
Article 4 (Period and Revision of Contract) (1) The contract period shall be from May 1, 2013 to December 31, 2026, and shall be determined through mutual consultation, if the grounds (extension of Permission and Extension) necessary for extending the contract occur.
Article 9 (Purchase of Land and Promotion of New Authorization) (1) The Plaintiff shall purchase 188,628 square meters of land necessary for new permission in the name of the Defendant, and ensure that the Plaintiff does not have any problem in the progress of quarrying permission.
