A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Any foreigner who violates the Immigration Control Act may sojourn in Korea within the limits of his/her sojourn status and period of sojourn;

The Defendant was a foreigner of the nationality of the People's Republic of China, entered Jeju Special Self-Governing Province as the visa visa (B-2) on February 27, 2018, and stayed in Jeju Special Self-Governing Province from March 30, 2018 to June 8, 2020, despite the expiration of the period of stay on March 29, 2018.

Accordingly, the defendant was staying in the Republic of Korea beyond the scope of his sojourn status and sojourn period.

2. The Defendant, who had a relation with the Defendant, was aware that the reason behind the Defendant’s nationality B was due to the Victim C (C, South and 35 years of age) in the People’s Republic of China’s Republic of China’s relationship with the Defendant.

Accordingly, at around 15:30 on June 8, 2020, the Defendant: (a) held a knife (18cm in knife length) knife of the victim, who was asked the victim from contact with the Defendant through the Manife, a mobile knife, from the Defendant, about the relationship with the said B; (b) had a knife (18cm in knife length) knife the victim’s chest part of the victim’s chest, which was a dangerous object, while asking the victim about the relationship with the said B.

As a result, the defendant carried dangerous things and carried the victim's injury to the victim who was unable to know the treatment period.
