A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. Around February 23, 2012, the Defendant, on February 23, 2012, made a false statement to the effect that “The Defendant would make reimbursement within one month, if he/she lends the shortage of construction cost, which he/she is doing construction work in the human river.”

However, the Defendant, at the time of completion of the Women's Middle School Construction in Incheon, did not receive some money from the original business entity. Moreover, the Defendant merely borrowed money from the said female middle school due to lack of money to be paid to the other business entity for the said female middle school construction work, and did not borrow money due to lack of money to be paid to the ongoing construction work. The Defendant was in a state of bad credit standing and bad credit standing of at least one billion won around 2005, and the Defendant did not have any intention or ability to repay the money differently even if she borrowed money.

Nevertheless, the Defendant received KRW 30 million from the victim on the same day on the same day, and received KRW 20 million in total, and acquired KRW 50 million.

2. Around March 23, 2012, the Defendant, on March 23, 2012, made a false statement to the effect that “Around March 23, 2012, the Defendant would receive money from the customer if he/she borrowed a shortage of construction cost, which he/she is performing construction work in In Mancheon.”

However, in fact, the Defendant merely borrowed money due to the lack of money to pay to the other party for the completed construction work, and did not receive money from the customer. The Defendant was in a state of bad credit and bad credit standing of at least one billion won in around 2005, and the Defendant did not have any other intent or ability to pay the money even if he borrowed money.

Nevertheless, the Defendant received 20 million won from the victim on the same day on the same day.

Accordingly, the defendant deceivings the victim two times.
