Defendant
A shall be punished by imprisonment with prison labor for four months and by imprisonment for six months.
However, from the date this judgment becomes final and conclusive, each one year.
Reasons
Punishment of the crime
1. On November 201, 2014, Defendant A plans to operate a small-term breabbhouse with the victim F from the Defendant’s house located in Ulsan-gu, Ulsan-gu, Seoul-gu, to the victim F.
The loan will be repaid up to June 30, 2010,000 won by lending KRW 50 million to the remodeling cost, to be entrusted with the management of the fed rice house in the above fed rice country, and to be repaid up to June 30, 2015.
“A false representation was made.”
However, at the time, the Defendant was urged to repay the loans of financial institutions of KRW 9,91,748, and personal loans of KRW 10,000,000,000. The Defendant was thought to use the loans from the damaged party for the repayment of the said personal loans due to economic difficulties that make it difficult to pay the loans of KRW 9,91,748.
As above, the Defendant: (a) was granted KRW 5 million in total to the Agricultural Cooperative Account under the name of the Defendant on December 17, 2014; and (b) KRW 15 million on December 18, 2014, to KRW 15 million, from the victim, under the pretext of borrowing money from the victim; and (c) was granted from the victim.
2. Defendant B, on December 16, 2014, concluded that “I would lend KRW 35 million to the victim F through I, and immediately complete payment,” from the Ulsan-gu “H” located in Ulsan-gu, Ulsan-gu, and I.
However, from June 2014, the Defendant was unable to pay KRW 220,000,00 to the material price and construction cost while carrying out the new construction of a commercial building in the postal innovation city. The work of the Labor Welfare Corporation and the Immigration Management Office run around that time, the issue of defective construction works and the delay in construction, which led to the occurrence of an enemy amounting to KRW 600,000,000,000. Ultimately, around December 2014, the financial situation has deteriorated to the extent that the subcontractor’s payment of construction cost was delayed, and the insurance premiums (from March 2013 to November 2015) of the Health Insurance Corporation (the insurance premium of the National Health Insurance Corporation) were unpaid, and thus, it is urged by the Health Insurance Corporation.
