All appeals are dismissed.
Reasons
The grounds of appeal are examined.
1. Examining the reasoning of the lower judgment in light of the evidence duly admitted and examined by the first instance court, which maintained the reasoning of the lower judgment, the lower court was justifiable to have determined that the Defendants guilty of violating the Trade Union and Labor Relations Adjustment Act among the facts charged in the instant case on the grounds stated in its reasoning.
In so doing, contrary to what is alleged in the grounds of appeal, the lower court did not err by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules, or by misapprehending the legal doctrine on the establishment of a crime of violation of Articles 88 and 4
2. As to the prosecutor’s grounds of appeal, the lower court upheld the first instance judgment that determined the Defendants not guilty on the ground that the Defendants’ obstruction of business among the facts charged in the instant case constituted a case where there is no proof of crime.
The judgment below
Examining the reasoning in light of the record, the above determination by the court below is just, and contrary to the allegations in the grounds of appeal, the court below did not err by misapprehending the legal principles on the establishment
3. Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
