1. As to KRW 767,953,725 and KRW 698,139,750 among the Plaintiff, the Defendant shall pay to the Plaintiff KRW 767,953,725 from October 30, 2012 to November 23, 2015.
Reasons
1. Facts of recognition;
A. On May 15, 2004, the Defendant entered into a sales contract between the Defendant and B with the Defendant on May 15, 2004, entered into a sales contract with the Defendant to purchase KRW 942/3,256 of the amount of KRW 105,00,000 among the amount of KRW 3,256,00,00 in Seocheon-gu, Seocheon-gu, Seocheon-gu, the land transaction permission zone B (hereinafter the above land’s land’s land’s land ownership, and the above share’s ownership’) located within the land transaction permission zone B, and paid KRW 105,00,000 for the purchase price to B.
B. On December 28, 2009, the public notice of the determination of urban planning facilities as to the instant land and the cancellation of the designation of a land transaction permission zone, the determination of urban planning facilities for the purpose of using the instant land was publicly notified as a university site. On January 13, 2012, the designation of a land transaction permission zone as to the instant land was revoked.
C. On February 20, 2012, the Defendant filed a lawsuit against B, such as filing a claim for ownership transfer registration against B, and filed a lawsuit against B on February 20, 2012, the Incheon District Court Branch Decision 2012Da4918, which rendered a judgment in favor of the Defendant on May 30, 2012, and subsequently completed the registration of ownership transfer in the name of the Defendant on June 22, 2012.
(1) On October 24, 2012, the Plaintiff entered into a sales contract between the Plaintiff and the Defendant with the Defendant to purchase shares in the instant land in KRW 698,139,750 (hereinafter “instant sales contract”).
(2) On the same day, the Plaintiff paid the remainder to the Defendant on October 30, 2012, and completed the registration of ownership transfer in the name of the Plaintiff as to the share in the instant land on the same day.
E. On November 22, 2012, B filed a lawsuit against the Plaintiff and the Defendant, the first instance court against the Defendant as the Incheon District Court 2012Na22969.
