1. With respect to the case of the voluntary auction of real estate, the Seoul Northern District Court E [F (Dual), G (Dual)] shall be held by the said court on September 28, 2016.
Reasons
1. Facts of recognition;
A. H and J completed the registration of ownership transfer on July 24, 2012 with respect to each of the instant housing units on the ground of sale and purchase on July 10, 2012. (2) On July 24, 2012, K Co., Ltd. completed the registration of ownership transfer on the instant housing units worth KRW 1,18,00,000 as joint collateral (hereinafter “instant collateral security”) around July 24, 2012, the debtor H and the maximum debt amount of KRW 1,18,00,000 as to the instant housing units (hereinafter “instant collateral security”).
B. L (1) Around July 10, 2012, with respect to the first floor of the instant housing, a lessee L, lessor H, J, J, lease deposit amounting to KRW 150,00,000, and a lease agreement (hereinafter “instant one lease agreement”) was completed from September 10, 2012 to 24 months from the lease term (hereinafter “instant lease agreement”).
A) On the same day, Defendant B made a move-in report on the instant house with the consent of H and J on August 23, 2012. After entering into a sub-lease contract with L as 130,000,000, and 130,000,000,000,000,000 of the sublease deposit for the instant house from September 10, 2012. Defendant B made a move-in report on the said house on August 30, 2012, and received the delivery of 1st floor on September 25, 2012, Defendant C concluded the lease contract and the instant housing M as H around January 17, 2014 and around 35,00,00,000 won for the lease deposit and the instant housing as 14,201, 201, 2014 or less (hereinafter referred to as “the lease lease contract and the instant housing”).
C. 1) Around February 27, 2015, the Seoul Northern District Court E rendered a decision to commence the auction of real estate as well as the Seoul Northern District Court F (Dual) and G (dual) around February 27, 2015 on the instant housing and the instant housing site and joint collateral goods, and the Plaintiff was a stock company.
